THE H.O.A. NIGHTMARE

In a Homeowners Association paralysed by a bitter dispute between two competing factions of directors, we employed our experience in Litigation and the Companies Act, securing High Court and Supreme Court orders reinstating the rightful directors.

POLITICAL INTERFERENCE IN LABOUR MATTERS

​

A client of ours engaged a contractor to do an installation at their offices. When the client saw the contractor's shoddy workmanship, it withheld the remaining 5% of the payment until the contractor had fixed the snags.

​

Sadly, instead of fixing the snags, the contractor chose instead to engage his favourite political party, who threatened our client with mass protest action outside its offices, using fear and destruction as a means of extorting payment.

 

We acted immediately to secure an urgent interdict against the unlawful gathering and took action against the political party and the contractor.

HELPING YOU DEAL WITH

CUSTOMER TANTRUMS

 

A disgruntled customer threatened a client with widespread defamation on Hellopeter, Facebook and other social media.

 

Turns out, the customer was just trying to escape from their contract unfairly.

 

A stern Cease and Desist letter from our firm convinced the customer that defaming our client would be unwise.

PROTECTING YOU FROM UNFAIR CONTRACTS

 

When an IT client was presented with a contract for the sale of its software by a buyer, we showed our client the hidden exclusivity clause which would have prevented him from selling his software to anyone else, while the buyer deliberated for six months with its board.

​

The buyer would've had the leverage to squeeze our client until he agreed to a lower purchase price.

 

We showed our client how one-sided and unfair that contract was, and helped him to re-negotiate better terms and a better sale price.

​

By seeking our guidance early in the process, the client secured an extra R2 million on the deal.

INCOMPETENT STAFF HOLDING YOU BACK

 

It's important to follow correct labour procedure when dismissing staff. Failure to do so can expose your business to CCMA awards of up to 24 times the salary of an employee dismissed unfairly.

 

When a client with a high staff complement was inundated by an avalanche of CCMA claims from poor-performing ex-staff, we helped to bat away each unfair dismissal claim.

We also helped the client to improve its labour processes to avoid future liabilities.

SPENDING MORE TIME WITH FAMILY

 

A successful Property Developer client wanted to retire and ensure his company was in good hands, to keep bringing returns for him and his family.

 

But his company wasn't structured to allow him time away from his desk.

 

We implemented a Succession Plan and restructured the operations of the client's offices to allow for remote working and increased productivity.

​

Now, he spends more time with family and less time at that desk.

BE CAREFUL WHO YOU GO INTO BUSINESS WITH

 

A young entrepreneur client of ours started her business with  a university friend, allocating shareholding in a 60:40 split.

 

Soon enough, she'd built the business into a profitable investment.

 

But she quickly realised she was doing all the work, while her friend, now a business partner and shareholder, was too busy partying, while reaping undeserved profits from the business.

 

She'd given away shares in her company too hastily, and now she needed help getting them back - never an easy task.

 

But with some skilful negotiation, and knowledge of how to use the Companies Act to her advantage, we helped her negotiate the repurchase of those shares, returning full control of the company to her - without having to resort to expensive litigation.

When a client of ours realised it had lost a tender bid to a company owned by the daughter of the Head of a State Department, the smell of corruption could be detected a mile away.

 

We helped to appeal the tender award, expose the corruption in the Department and restart the tender process.
